User Agreement to Policy

By uploading an image, customizing a product and or placing an order with tk.gifts, you acknowledge that you have read, understood, and agreed to be bound by this policy. This agreement is effective upon your use of our service and remains effective until terminated by either you or us.

You are solely responsible for ensuring that your use of our services is in compliance with this policy and all applicable laws and regulations.

Customer's Responsibility

When you upload an image or customize text on tk.gifts for laser engraving, you affirm that you have the legal right to use the image or text. This includes ensuring that the image or text does not infringe upon the copyrights, trademarks, or other intellectual property rights of third parties.

You agree to indemnify and hold harmless tk.gifts, its affiliates, officers, agents, employees, and partners from any claim or demand, including reasonable attorneys’ fees, made by any third party due to or arising out of your violation of these terms, your violation of any rights of another, or any content you submit, post, transmit, or otherwise make available through our services.

While tk.gifts does not review the content for legal compliance, we reserve the right to refuse to process any order that we believe may infringe on the rights of a third party or violate any laws.

Tk Gifts Limitation of Liability

Tk.gifts is not responsible for the content of the images and or text or any other customizations made by the customer. Our role is strictly limited to laser engraving as per the customer’s instructions.

We do not redistribute, share, or otherwise make public any images, text or customizations made by our customers. All uploaded or customized content is considered confidential and is used solely for the purpose of fulfilling your order.

In no event shall tk.gifts, its officers, directors, employees, or agents, be liable for any direct, indirect, incidental, special, punitive, or consequential damages whatsoever resulting from any (i) errors, mistakes, or inaccuracies of content, (ii) personal injury or property damage, of any nature whatsoever, resulting from your access to and use of our services, (iii) any unauthorized access to or use of our secure servers and/or any and all personal information and/or financial information stored therein.

By using our Sites each User agrees that Tk.gifts shall not be liable for any damages, including without limitation, direct or indirect, special, incidental, or consequential damages, losses or expenses arising in connection with these Sites or any use thereof or inability to use by any party, or in connection with any failure of performance, omission, error, interruption, delay / non-receipt in operation or transmission, defect, computer virus or line or system failure, even if Tk Gifts, or representatives thereof, are advised of the possibility of such issues, damages, losses or expenses. 

By using our Sites, you expressly agree to release, defend, indemnify, and hold harmless Tk.gifts, its Sites, and its affiliates, officers, directors, employees, agents and representatives, from any and against any and all demands, claims, damages, costs, and expenses, including reasonable attorneys’ fees arising from or relating to your use of the Sites, your violation of this User Agreement, and/or your violation of any rights of another.

Intellectual Property

Tk.gifts respects the intellectual property rights of you and others. We prohibit users from uploading, posting, or otherwise transmitting on the tk.gifts website any materials that violate another party's intellectual property rights.

If you believe that your work has been copied in a way that constitutes copyright infringement, please provide us with the following information: a description of the copyrighted work that you claim has been infringed; a description of where the material that you claim is infringing is located on the site; your address, telephone number, and email address; a statement by you that you have a good faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law.

Amendments

tk.gifts reserves the right to amend this policy at any time. All amendments to this policy will be posted on the website and effective immediately upon posting.
